LIMITED WARRANTY

(UNITED KINGDOM)

Effective: 26 July 2024

Your SPECS and any Specs-branded accessories (each, a “Product”) are covered by a limited warranty.

WHO IS THIS WARRANTY FROM AND WHO MAY USE THIS WARRANTY?

Specs Inc. of 3000 31st Street, Santa Monica, California 90405, U.S.A. (“Specs,” “we,” or “our”) issues this warranty to you, as a consumer who originally purchased a new, covered Product from us or an authorized retailer in the United Kingdom or who lawfully received such Product from the original consumer purchaser. The warranty is not available for Products that were purchased from any source other than us or an authorized retailer in the United Kingdom.

 

WHAT DOES THIS WARRANTY DO?

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state and country to country. This warranty does not affect any rights you have under the laws in your jurisdiction concerning the sale of consumer goods.

 

WHAT IS COVERED BY THIS WARRANTY?

This warranty covers faulty materials or workmanship in your Product. We warrant that your Product will be free from manufacturing defects and, under normal and intended use, function substantially in accordance with our published technical specifications or product documentation available here (“Warranted Functionality”) during the applicable warranty period set forth below. Other than as set out in this warranty, and to the extent permitted by applicable law, Specs disclaims all implied warranties, conditions or representations regarding the Product.

 

HOW LONG DOES WARRANTY COVERAGE LAST?

This limited warranty period begins on the date of the original purchaser’s purchase of your Product or date of delivery of your Product to the original purchaser, whichever is later, and continues as follows:

SPECS 27 and Accessories          1 year

Nosepad Kit and Cleaning Cloth      90 days

This does not affect any statutory rights.

WHAT IS NOT COVERED BY THIS WARRANTY?

This warranty does not cover damage resulting from: (a) accident, (b) normal wear and tear, (c) improper storage, (d) misuse, neglect or abuse or abnormal use, (e) disassembly or tampering, (f) use with unsuitable third-party software, hardware or other materials, or (g) exposure to fire, extreme heat, water, dirt, sand, or other external causes or extreme conditions. “Misuse” includes without limitation use in a manner or environment not in compliance with the recommendations in this warranty, our user manual, or other related documentation. 

This warranty does not cover consumable parts that diminish over time (such as batteries) or cosmetic damage (such as discoloration, scratches, cracks or surface damage), unless failure occurred due to a defect in original materials or workmanship. This warranty does not cover Products that have been physically or electronically altered, modified, undergone unauthorized repairs, or exhibit third-party software changes. This warranty does not cover software or firmware embedded in or distributed with the Product. Prescription lenses are also not covered by this warranty. The third party manufacturer may provide their own warranties to you and you should contact them for further information. This warranty does not guarantee that use of your Product will be uninterrupted, secure, error-free, that data loss will not occur, or that your Product will be compatible with any third-party hardware, equipment, or software.

 

WHAT WILL WE DO?

If your Product is defective or malfunctioning during the warranty period, we will replace or repair it using new or refurbished materials, so that it performs substantially according to the Warranted Functionality, or provide a whole or partial refund of the price paid for the Product. Please let us know if you would like to receive a repair, replacement, or refund, and we will do our best to accommodate your preference, subject to what is feasible and proportionate. If we replace your Product, we warrant that the replacement Product will be free of faulty materials or workmanship for the remainder of the original warranty period for the defective Product or 90 days after you receive the replacement Product, whichever is later. All returned Products for which you have received a replacement or refund become the property of Specs.

 

HOW TO OBTAIN WARRANTY SERVICE?

First, tell us about the problem. Please visit us at support.specs.com or email support@specs.com to request warranty service during your Product’s warranty period. Prior to providing warranty service, we may require you to provide proof of purchase details, such as a receipt or sales invoice. If your Product needs to be repaired or replaced, you’ll need to return it to us using our shipping instructions. Once we receive the Product, we’ll determine if it has a defect or malfunction covered by this warranty. If so, we’ll repair or replace it to provide the Warranted Functionality, and we’ll send the repaired or replacement Product to you at our cost. We must receive your request for warranty service during your Product’s warranty period in order to be eligible for warranty services. If we determine your Product is not covered by this warranty, we will have no warranty obligations, we may choose not to service or repair your Product (even for a fee) and you may be required to pay shipping costs for us to return your Product to you.

 

WHAT ARE YOUR RESPONSIBILITIES REGARDING DATA?

This warranty does not cover data loss. You are responsible for maintaining backup copies of your data. Before sending your Product to Specs for warranty services, you should backup copies of your data you want to save and delete any personal information or information you consider confidential. We can’t guarantee that we’ll be able to repair your Product without risk to or loss of data or that your data will be transferred to any repaired or replaced Product.

LIMITATION OF LIABILITY

WE DO NOT, UNDER THIS LIMITED WARRANTY, ASSUME ANY LIABILITY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR REVENUES, LOSS OF DATA, LOSS OF USE OF THE PRODUCT OR ANY ASSOCIATED EQUIPMENT, COST OF ANY REPLACEMENT GOODS OR SUBSTITUTE EQUIPMENT, OR LOSS OF USE DURING THE PERIOD THE PRODUCT IS BEING REPLACED OR REPAIRED. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, IN THE EVENT OF A PRODUCT REPLACEMENT, WE ARE NOT LIABLE FOR ANY ASSOCIATED DATA LOSS OR CONSEQUENTIAL DAMAGES OF ANY KIND.

FURTHER, TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ASSUME NO LIABILITY FOR ANY ACCIDENT, INJURY, DEATH, LOSS, OR OTHER CLAIM RELATED TO OR RESULTING FROM THE MISUSE OF PRODUCTS. WE SPECIFICALLY ADVISE YOU AGAINST USING PRODUCTS IN A MANNER INCONSISTENT WITH THIS WARRANTY, OUR USER MANUAL, OUR WARNINGS, OUR COMPATIBILITY PAGE, AND OTHER RELATED DOCUMENTATION. IN NO EVENT WILL OUR LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THIS WARRANTY EXCEED THE PRODUCT PURCHASE PRICE PAID BY YOU.

The disclaimers and limitations of liability above do not limit your rights under applicable law, and do not apply to the extent liability cannot be disclaimed under applicable law, including without limitation applicable product liability and consumer protection laws. If any term herein is held to be illegal or unenforceable under applicable law, such term shall be severed from this warranty and to the extent legally permitted, the remaining terms shall not be affected.

 

GOVERNING LAW AND DISPUTE RESOLUTION

This warranty will be governed by the Governing Law and Dispute Resolution provision of our Specs Terms of Sale.

MISCELLANEOUS

If there are any differences between this online warranty and the warranty included in the original packaging of your Product, this online warranty will supersede and control.  No seller, authorized reseller, or employee or representative of Specs is authorized to make any modification, extension or addition to this warranty. If any provision of this warranty is found unenforceable, then that provision will be removed and not affect the validity and enforceability of any remaining provisions.
