Your SPECS and any Specs-branded accessories (each, a “Product”) are covered by this limited warranty.

ARBITRATION NOTICE: IF YOU LIVE IN THE UNITED STATES, EXCEPT FOR CERTAIN TYPES OF DISPUTES MENTIONED IN THE ARBITRATION PROVISION OF THE SPECS TERMS OF SALE, YOU AND SPECS AGREE THAT DISPUTES BETWEEN US WILL BE RESOLVED BY MANDATORY BINDING ARBITRATION, AND YOU AND SPECS WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS-ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

Specs Inc. of 3000 31st Street, Santa Monica, California 90405, U.S.A. (“Specs,” “we,” or “our”) issues this warranty to you, as a consumer who originally purchased a new, covered Product from us or an authorized retailer or who lawfully received such Product from the original consumer purchaser. The warranty is not available for Products that were purchased from any source other than us or an authorized retailer.

This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state and country to country. This warranty does not affect any rights you have under the laws in your jurisdiction concerning the sale of consumer goods.

This warranty covers faulty materials or workmanship in your Product. We warrant that your Product will be free from manufacturing defects and, under normal and intended use, function substantially in accordance with our published technical specifications or product documentation available here (“Warranted Functionality”) during the applicable warranty period set forth below.

This limited warranty period begins on the date of the original purchaser’s purchase of your Product or date of delivery of your Product to the original purchaser, whichever is later, and continues as follows:

Nosepad Kit and Cleaning Cloth      90 days

This warranty does not cover damage resulting from: (a) accident, (b) normal wear and tear, (c) improper storage, (d) misuse, neglect or abuse or abnormal use, (e) disassembly or tampering, (f) use with unsuitable third-party software, hardware or other materials, or (g) exposure to fire, extreme heat, water, dirt, sand, or other external causes or extreme conditions. “Misuse” includes without limitation use in a manner or environment not in compliance with the recommendations in this warranty, our user manual, or other related documentation.

This warranty does not cover consumable parts that diminish over time (such as batteries) or cosmetic damage (such as discoloration, scratches, cracks or surface damage), unless failure occurred due to a defect in original materials or workmanship. This warranty does not cover Products that have been physically or electronically altered, modified, undergone unauthorized repairs, or exhibit third-party software changes. This warranty does not cover software or firmware embedded in or distributed with the Product. Prescription lenses are also not covered by this warranty. The third-party manufacturer may provide their own warranties to you and you should contact them for further information. This warranty does not guarantee that use of your Product will be uninterrupted, secure, error-free, that data loss will not occur, or that your Product will be compatible with any third-party hardware, equipment, or software.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY IS THE ONLY EXPRESS WARRANTY THAT SPECS PROVIDES FOR YOUR PRODUCT AND THE REMEDIES SET FORTH HEREIN ARE THE SOLE AND EXCLUSIVE REMEDIES AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED, REGARDING YOUR PRODUCT. TO THE EXTENT PERMITTED BY APPLICABLE LAW, SPECS DISCLAIMS ALL STATUTORY AND IMPLIED WARRANTIES REGARDING YOUR PRODUCT, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, EXCEPT THAT ANY WARRANTIES THAT CANNOT BE DISCLAIMED ARE LIMITED TO THE DURATION OF THE EXPRESS WARRANTY AND REMEDIES SET FORTH HEREIN. SOME STATES, PROVINCES OR COUNTRIES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

If your Product is defective or malfunctioning during the warranty period, we will replace or repair it using new or refurbished materials, so that it performs substantially according to the Warranted Functionality, or provide a whole or partial refund of the price paid for the Product. We may replace, repair, or provide a refund at our sole discretion. This is your exclusive remedy. If we replace your Product, we warrant that the replacement Product will be free of faulty materials or workmanship for the remainder of the original warranty period for the defective Product or 90 days after you receive the replacement Product, whichever is later. All returned Products for which you have received a replacement or refund become the property of Specs.

First, tell us about the problem. Please visit us at support.specs.com or email support@specs.com to request warranty service during your Product’s warranty period. Prior to providing warranty service, we may require you to provide proof of purchase details, such as a receipt or sales invoice. If your Product needs to be repaired or replaced, you’ll need to return it to us using our shipping instructions. Once we receive the Product, we’ll determine if it has a defect or malfunction covered by this warranty. If so, we’ll repair or replace it to provide the Warranted Functionality, and we’ll send the repaired or replacement Product to you at our cost. We must receive your request for warranty service during your Product’s warranty period in order to be eligible for warranty services. If we determine your Product is not covered by this warranty, we will have no warranty obligations, we may choose not to service or repair your Product (even for a fee) and you may be required to pay shipping costs for us to return your Product to you.

This warranty does not cover data loss. You are responsible for maintaining backup copies of your data. Before sending your Product to Specs for warranty services, you should backup copies of your data you want to save and delete any personal information or information you consider confidential. We can’t guarantee that we’ll be able to repair your Product without risk to or loss of data or that your data will be transferred to any repaired or replaced Product.

SANS LIMITER LA GÉNÉRALITÉ DE CE QUI PRÉCÈDE, EN CAS DE REMPLACEMENT D'UN PRODUIT, NOUS NE SOMMES PAS RESPONSABLES DES ÉVENTUELLES PERTES DE DONNÉES ASSOCIÉES OU DES DOMMAGES-INTÉRÊTS CONSÉCUTIFS, DE QUELQUE NATURE QUE CE SOIT.

DE PLUS, DANS LA MESURE MAXIMALE PERMISE PAR LA LOI, NOUS N'ASSUMONS AUCUNE RESPONSABILITÉ EN CAS D'ACCIDENT, DE BLESSURE, DE DÉCÈS, DE PERTE OU DE TOUTE AUTRE RÉCLAMATION LIÉE À UNE MAUVAISE UTILISATION DES PRODUITS OU RÉSULTANT DE CELLE-CI. NOUS VOUS DÉCONSEILLONS SPÉCIFIQUEMENT D'UTILISER LES PRODUITS D'UNE MANIÈRE INCOMPATIBLE AVEC LA PRÉSENTE GARANTIE, NOTRE MANUEL DE L'UTILISATEUR OU L'UTILISATRICE, NOS AVERTISSEMENTS, NOTRE PAGE DE COMPATIBILITÉ ET TOUTE AUTRE DOCUMENTATION CONNEXE. NOTRE RESPONSABILITÉ DANS LE CADRE D'UNE RÉCLAMATION DÉCOULANT DE OU LIÉE À LA PRÉSENTE GARANTIE NE SAURAIT EN AUCUN CAS DÉPASSER LE PRIX D'ACHAT DU PRODUIT DONT VOUS VOUS ÊTES ACQUITTÉ OU ACQUITTÉE.

 Les exonérations et limitations de responsabilité ci-dessus ne limitent pas vos droits en vertu de la loi applicable et ne s'appliquent pas dans la mesure où la responsabilité ne peut pas être exclue en vertu de la loi applicable, y compris, sans s'y limiter, les lois applicables sur la responsabilité du fait des produits et la protection des consommateurs. Si l'une des présentes conditions est jugée illégale ou inapplicable en vertu de la loi applicable, elle sera dissociée de la présente garantie et, dans la mesure autorisée par la loi, les autres conditions ne seront pas affectées.

La présente garantie sera régie par la clause relative à la loi applicable et au règlement des litiges de nos Conditions de vente des Specs.

En cas de divergence entre la présente garantie en ligne et la garantie incluse dans l'emballage d'origine de votre Produit, la présente garantie en ligne prévaudra.  Aucun vendeur, revendeur autorisé, employé ou représentant des Specs n'est autorisé à apporter une modification, une extension ou un ajout à la présente garantie. Si l'une des clauses de la présente garantie est jugée inapplicable, elle sera supprimée et n'affectera pas la validité et l'applicabilité des autres clauses.
