Welcome! We are excited that you are interested in Snap's Lens+ Payout Programme ("Programme"). The Programme permits eligible users who have accepted these Terms (who we refer to throughout these Terms as “Service Providers” or “Creators”) with the opportunity to receive monetary incentives from Snap in connection with their services of creating and submitting high-performing Lenses on Snapchat within Lens Studio, which we define as “Qualifying Activity” and describe further below. 

We’ve drafted these Lens+ Payout Programme Terms (the “Terms”) so that you’ll know the rules that apply to and govern your submission of Lenses to, and participation in, the Programme, if eligible, as set forth in these Terms. These Terms form a legally binding contract between you (or your organisation) and the applicable Snap entity as detailed in the Creator Payment Terms (“Snap”), so please read them carefully. Only users who accept and comply with these Terms will be eligible to participate in the Programme.

The Programme, and each product and service described in these Terms, are "Services" as defined in the Snap Terms of Service. These Terms incorporate by reference the Terms of Service, Community Guidelines, Lens Studio Terms, Lens Studio License Agreement, Generative Lens Tools Terms, Snap Creator Payment Terms, Snapchat Brand Guidelines, Snapcode Usage Guidelines, Music On Snapchat Guidelines and Lens Studio Submission Guidelines, and any other applicable terms, guidelines and policies (each an “Incorporated Term”, and collectively, the “Incorporated Terms”). Please also review our Privacy Policy to learn how we handle information when you use the Services.

To the extent these Terms conflict with any Incorporated Term, these Terms will control with respect to your participation in the Programme. All capitalised terms used but not defined in these Terms shall have the respective meanings set forth in the applicable Incorporated Term.  

Any user, account or Lens that violates these Terms or any Incorporated Term will not be eligible for monetisation. For the avoidance of doubt, you must not use or include any music in your Lenses unless you hold all rights in and to such music (including having originally composed, created, performed and recorded all the music and lyrics yourself) or have separately obtained all rights and or applicable licenses necessary to distribute, synchronise, copy, display, publicly perform and otherwise use such music in your Lenses worldwide, including from any applicable record labels, music publishers and other rights holders. Any unauthorised use of music in connection with the Programme may result in, among other things, suspension or termination of your ability to participate in the Programme.

Where we have provided summaries in these Lens+ Payout Programme Terms, we have done so for your convenience only. You should read these Lens+ Payout Programme Terms in full to understand your legal rights and obligations.

YOU MAY RECEIVE PAYMENTS FOR YOUR SERVICES IF YOU, THE LENSES YOU SUBMIT, AND YOUR PAYMENT ACCOUNT SATISFY THE MINIMUM ELIGIBILITY CRITERIA.

All Lenses submitted by you to the Programme shall be submitted in accordance with and subject to the Lens Studio Terms and Lens Studio Licence Agreement. Lenses submitted to the Programme will be subject to review for compliance with these Terms, in accordance with Snap's moderation algorithms and review procedures, and Lenses that do not comply may not be eligible for the Programme. If you have been engaged by or on behalf of Snap outside of these Terms to create or provide Lenses specifically for Snap, you may not be eligible for Payments for those Lenses you created as part of that engagement. Qualifying Lenses (defined below) will be distributed through Snap’s proprietary content distribution algorithm and procedures. If you meet the Minimum Eligibility requirements, have accepted these Terms, and have submitted Qualifying Lenses, then you may receive monetary incentives from Snap for performing the services described herein (“Qualifying Activity”).

To be considered a “Qualifying Lens”, the Lens that you submit to the Programme must: (i) have been enrolled in Lens+ Payouts Programme upon submission; and (ii) be an engaging Lens aggregated across all Snapchat+ subscribers, calculated in accordance with our proprietary formula, which may include account performance and user engagement. Solely in the event your Lens is deemed a Qualifying Lens, you will be notified that such Lens has been published.

We may need to update these Lens+ Payout Programme Terms from time to time. If those changes to these Lens+ Payout Programme Terms are material, we will provide you with reasonable advance notice (unless changes are required sooner, for example, as a result of a change in legal requirements or where we are launching new Services or features). If you continue to participate in the Programme once the changes come into effect, we will take that as your acceptance. If at any time you don't agree to any changes to these Lens+ Payout Programme Terms, you must stop participating in the Programme. These Lens+ Payout Programme Terms do not create or confer any third-party beneficiary rights. Nothing in these Lens+ Payout Programme Terms will be construed to imply a joint-venture, principal-agent or employment relationship between you and Snap or Snap’s affiliates. If we do not enforce a provision in these Lens+ Payout Programme Terms, it will not be considered a waiver. We reserve all rights not expressly granted to you. These Lens+ Payout Programme Terms were written in English and to the extent any translated version of these Lens+ Payout Programme Terms conflicts with the English version, the English version will control. If any provision of these Lens+ Payout Programme Terms is found unenforceable, then that provision will be removed from these Lens+ Payout Programme Terms and will not affect the validity and enforceability of any remaining provisions. 

In Summary: You should review these Lens+ Payout Programme Terms because we may update them. These Lens+ Payout Programme Terms do not create any type of employment relationship between us. The English version of these Lens+ Payout Programme Terms will control, and certain provisions will remain in effect, even after they expire or terminate.
